Welcome to Swyller. These Terms of Service ("Terms") govern your use of the Swyller application and website. By using Swyller, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using Swyller, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our service.

2. Description of Service

Swyller is a desktop application that automatically organizes files in your Downloads folder by categorizing them based on file type. The service includes:

  • Automatic file monitoring and organization
  • File categorization into predefined folders
  • Duplicate file handling
  • Optional smart file renaming

3. Account Registration

To use Swyller, you must create an account with a valid email address. You are responsible for:

  • Providing accurate account information
  • Maintaining the security of your account credentials
  • All activities that occur under your account

4. Free Trial and Subscription

Free Trial

New users receive a 3-day free trial with full access to all features. No credit card is required to start the trial.

Subscription Plans

After the trial period, you must subscribe to continue using Swyller. We offer:

  • Monthly subscription at €4.99 per month
  • Yearly subscription at €39.99 per year

Payment and Billing

Subscriptions are billed in advance on a monthly or yearly basis. You authorize us to charge your payment method for all applicable fees.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months or years, except as described in our Refund Policy.

5. Refund Policy

We offer a 14-day money-back guarantee on new paid subscriptions. If you are not satisfied with Swyller within 14 days of your first payment, contact us for a full refund. This policy does not apply to renewal payments.

6. User Conduct

You agree not to:

  • Use Swyller for any illegal purposes
  • Attempt to reverse engineer, decompile, or disassemble the application
  • Share your account credentials with others
  • Circumvent or attempt to circumvent any security features
  • Use the service in any way that could damage or impair it

7. Intellectual Property

Swyller and all its components, including but not limited to the software, design, logos, and documentation, are owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use Swyller for personal purposes.

8. Your Files and Data

You retain all ownership rights to your files. Swyller processes your files locally on your computer and does not upload, store, or access your files on our servers. We are not responsible for any loss or damage to your files.

9. Disclaimer of Warranties

SWYLLER IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. USE OF SWYLLER IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF SWYLLER.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SWYLLER IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the application. Continued use of Swyller after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by contacting support or using the account deletion feature.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
